One-time purchases, non-expiring credits and a parent-managed experience. Your mandatory consumer rights are not waived.
01About these terms
These Terms of Use cover the Santa Calls website and, when released, the Santa Calls service operated by Kroonverse (“we”, “us”). They are addressed to the adult parent or legal guardian (“you”), not to a child. Questions can be sent to jacobdegrootnl@gmail.com.
Santa Calls is currently coming soon. Product descriptions and prices describe the intended experience; this website does not sell calls. Private testing is for adults using fictional profiles only. Do not submit real child information to a private build.
The Privacy Policy forms part of the service information. Accepting terms or reading the policy is not a substitute for the separate parental notice and consent required before a child uses the service.
02Use by a parent or guardian
You must be at least 18 and the child’s parent or legal guardian with authority to approve the processing involved. You prepare the profile, choose suitable personalisation and decide when the call starts. Stay available to supervise and stop the conversation if needed.
Provide only information you are entitled to share. Use positive, age-appropriate details and avoid unnecessary sensitive information. Parental responsibility does not remove Kroonverse’s own privacy, safety or consumer-law obligations.
Public child use will remain blocked until the required provider data-retention approval and applicable child-privacy safeguards have been completed. We do not treat “parent managed” branding as an exemption from children’s privacy law.
03The experience
Santa Calls generates a live Santa conversation using the details prepared by a parent. It does not connect to a real person named Santa Claus. It is entertainment, not childcare, an emergency service, professional advice, therapy or a tool for disciplining a child.
Generated speech is variable and may be inaccurate or unexpected. We do not guarantee a specific response, that every detail will be mentioned or a change in a child’s behaviour. End an unsuitable conversation and contact support. For immediate danger, use local emergency services, not the app.
The planned free introductory call lasts around 60 seconds. Paid calls last up to three minutes. Connection conditions, interruptions and the closing conversation may affect duration. The app requires a compatible iPhone, microphone permission and an internet connection; your normal network charges may apply.
04Purchases, credits & your device
Planned US pricing is $4.99 for one call and $9.99 for three calls. The App Store price displayed before confirmation governs the purchase and may vary by region, currency and tax. These are one-time consumable purchases, not subscriptions.
- Purchased call credits do not expire.
- Available credits can be used for any child you add to the same installation.
- A prepared call reserves a credit. It is consumed when the live provider session becomes ready, not merely when you open the offer or incoming-call screen.
- Purchasing does not automatically start a call. You decide when to call and can edit the prepared details first.
- Calls cannot be resold, exchanged for cash or transferred to another user, except where the law requires otherwise.
Important: credits are tied to the installation
The current design has no user account or guaranteed cross-device recovery. Apple’s normal restore flow does not automatically restore consumed consumable purchases. Removing the app, resetting a device or changing phones may affect access to installation-linked credits. Contact support before doing so; do not assume credits will transfer automatically. This does not limit your statutory remedies or make a purchased credit expire.
Deleting child profiles through the app is different from deleting the installation: valid credits are intended to remain available without retaining the child’s personalisation.
05Failed calls, refunds & purchase problems
A failure before the provider is ready is designed to release the reserved credit. A call that connects and is then interrupted is not automatically guaranteed a replacement credit. If a paid call fails, contact us with the approximate time and problem; do not send your child’s conversation. We will investigate and provide the remedy required by applicable law.
Apple handles payments and its refund process. You can request a refund through Apple’s purchase support. We can help investigate service issues. Nothing here excludes rights to a refund, repeat performance, price reduction or other remedy provided by mandatory consumer law.
If Apple refunds or revokes a transaction, related unused credits may be removed. We may temporarily restrict disputed or fraudulent entitlements while resolving the issue. Digital-content withdrawal rights depend on the applicable law and the disclosures and express consents provided in the purchase flow; these Terms do not waive them.
06Keeping the experience safe
You must not use the service to harm, frighten, shame, sexually exploit or threaten a child, solicit secrets or sensitive information, or impersonate a person for a harmful purpose. Do not submit unlawful, abusive or infringing material.
Do not bypass consent, security, payment or call-duration controls; share access credentials; disrupt the service; extract protected assets; or automate abusive use. Restrictions on reverse engineering apply only to the extent permitted by law and do not override non-excludable rights.
We may decline, end or restrict access where reasonably necessary for safety, fraud prevention, security or compliance. Where appropriate and lawful, we will explain the reason and let you contact us about it. Suspension does not automatically cancel statutory rights or justify retaining unearned payments.
07Privacy & withdrawing consent
The Privacy Policy explains profile storage, live voice processing, providers and parent choices. Call content is processed to provide the requested experience, not for advertising. We do not claim production Zero Data Retention is active before it has been confirmed.
Withdrawing required consent stops further child calls until valid consent is provided again. You can remove saved child information. Limited purchase and security records may remain as described in the policy; buying a call never removes your right to withdraw consent.
08Ownership & permitted use
The app’s code, branding, interface and original or licensed artwork and audio remain the property of their respective rights holders. Your permission is to use the service for personal, non-commercial family entertainment, subject to Apple’s licence and applicable law. It is not a licence to extract or commercially redistribute protected assets.
You retain any rights in the information you provide. You permit us and the necessary service providers to process it only for the service and related purposes described in the Privacy Policy. This permission does not create a right to sell child information or override deletion and consent rights.
Generated content may not be unique, and no exclusive intellectual-property rights in a generated response are promised.
09Availability & changes
Calls rely on devices, networks and service providers. Reasonable maintenance, failures or safety restrictions may interrupt availability. We do not promise that service will be continuous or error-free, but remain responsible for the obligations the law places on us.
We may make proportionate updates to improve or protect the service. If a change or closure materially affects purchased value, we will provide appropriate notice and remedies required by law. Non-expiring credits are not a promise that an unchanged service will operate forever, nor permission to remove purchased value without a lawful remedy.
10Responsibility & consumer protection
We are responsible for losses to the extent required by applicable law. Subject to that law, we are not responsible for losses that were not reasonably foreseeable when the service was agreed, business losses arising from a service offered for personal use, or loss caused solely by misuse or circumstances genuinely outside our reasonable control.
We do not exclude liability that cannot lawfully be excluded, including fraud, deliberate wrongdoing or applicable liability for death or personal injury. No clause removes mandatory digital-content warranties, privacy rights or consumer remedies. A supplier’s involvement does not by itself remove our responsibility to you.
11Apple’s app licence
The App Store app uses Apple’s standard End User License Agreement where applicable, rather than a separate custom app EULA. These service terms supplement, and do not replace, that software licence or Apple’s purchase terms. Kroonverse operates the Santa Calls experience and provides its support.
12Applicable law & disputes
Dutch law governs these Terms, without depriving you of mandatory consumer protections in your country or state of residence. Applicable United States children’s privacy and consumer requirements still apply when serving US families; choosing Dutch law does not avoid them.
Please contact us so we can try to resolve concerns. You retain access to the courts and regulators available under applicable law. We do not impose mandatory arbitration or a class-action waiver in these Terms.
13Updates & contact
We may update these Terms for changes to the service or legal requirements. Material changes will receive appropriate notice and cannot retrospectively remove mandatory rights or already-purchased value. Fresh agreement will be obtained where required.
If a provision cannot be enforced, the remaining terms apply to the extent permitted by law. Any replacement must respect the original lawful purpose and consumer protections.
